Welcome to Augmented Minds AI. 


These Terms of Service ("Terms") govern your use of our website, augmentedmindsai.blogspot.com (the "Site"), and the services we provide (the "Services"). By accessing our Site or using our Services, you agree to be bound by these Terms.


1. Description of Service

Augmented Minds AI provides the development and setup of custom artificial intelligence (AI) models ("Models") built on the Google Gemini platform. Our service includes an initial consultation to determine your business needs, the development of a bespoke AI model tailored to those needs, and the final setup and integration of the Model for your use.


2. Payments and Fees

Our standard service for the development of one custom AI model is offered for a one-time fee of $300 CAD. This fee is non-refundable and due prior to the final delivery and setup of the Model. All fees are exclusive of any applicable taxes. We reserve the right to change our pricing for any services not yet purchased.


3. Intellectual Property Rights

Your ownership of the final product is important to us. The intellectual property rights are defined as follows:

• Client Ownership: Upon our receipt of your full and final payment, you, the Client, will be granted full ownership of the specific, trained instance of the AI Model created for your use. You may use this Model for any legal purpose related to your business.

• Augmented Minds AI Ownership: Augmented Minds AI retains all rights, title, and interest in and to all of our underlying code, development techniques, algorithms, processes, and pre-existing materials used to create the Model. We reserve the right to use these underlying components for other projects.


4. Client Responsibilities

To ensure the success of the project, you agree to:

• Provide accurate, complete, and timely information during the discovery and consultation process.

• Use the delivered AI Model in a lawful manner and in compliance with all applicable laws and regulations.

• Acknowledge that you are solely responsible for the output generated by the AI Model and how you choose to use it in your business operations.


5. Disclaimer of Warranties

The Services and AI Models are provided on an "as is" and "as available" basis. Augmented Minds AI makes no warranties, expressed or implied, regarding the operation of the Services or the output of the AI Models. We do not warrant that the Models will be error-free, uninterrupted, or that their output will be completely accurate or suitable for any specific purpose. The nature of artificial intelligence is complex, and unexpected outputs may occur.


6. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Augmented Minds AI, its owners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the Service or AI Model.

• Any output, content, or conduct of any third party using the Service.

• Any content obtained from the Service.

Our total liability to you for any and all claims arising from the use of our Service is limited to the amount you paid us for the Service.


7. Term and Termination

These Terms will remain in full force and effect while you use the Site or Services. We may terminate or suspend your access to our Service at any time, without prior notice or liability, for any reason, including without limitation if you breach the Terms.


8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of New Brunswick, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Moncton, New Brunswick for the resolution of any legal matter arising from the Terms.


9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of changes by updating the "Last Updated" date of these Terms. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
